TERMS OF SERVICE AND USER AGREEMENT

1. PREAMBLE AND SCOPE
These Terms of Service ("Terms") constitute a legally binding agreement between Tastenkunst GmbH ("Tastenkunst," "we," "us," or "our"), a company registered in the Commercial Register of the District Court of Leipzig under HRB 24784, Managing Director: Marcel Baumberg, and the user ("User" or "you") regarding your use of the Eternl software.
The "Software" or "Services" includes the website (e.g., eternl.io), browser extensions, mobile applications (iOS/Android), desktop applications, optional paid Eternl Pro plans, license activation and seat-management features, and any associated APIs provided by Tastenkunst.
BY DOWNLOADING, INSTALLING, OR USING THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY STOP USING THE SOFTWARE.
IMPORTANT NOTICE: ETERNL IS A NON-CUSTODIAL (SELF-CUSTODY) SOFTWARE. WE DO NOT HAVE ACCESS TO YOUR PRIVATE KEYS, RECOVERY PHRASES, OR FUNDS. WE CANNOT RECOVER YOUR FUNDS IF YOU LOSE YOUR CREDENTIALS.
2. THE SERVICES (NON-CUSTODIAL NATURE)
2.1 Self-Custody
Eternl is a non-custodial interface that allows you to interact directly with the Cardano blockchain. You retain full control and responsibility for your private keys, seed phrases, and hardware wallets.
2.2 No VASP Status
Tastenkunst is not a Virtual Asset Service Provider (VASP), a bank, an exchange, or a custodian. We do not store, send, or receive assets on your behalf. We provide the software tool; you perform the actions.
2.3 Supported Assets
The Software currently supports Cardano (ADA), Cardano-native assets, and any additional networks or features explicitly made available in the app. Certain license-related transactions may be created on Cardano mainnet or Apex Fusion Prime Mainnet. Sending unsupported assets (e.g., Bitcoin, Ethereum) to an Eternl address may result in the permanent loss of those assets.
2.4 Updates
To the extent required by statutory law (including § 327f BGB), we will provide security and maintenance updates necessary to keep the Software in conformity with the contract ("Necessary Updates"). You are responsible for installing these updates promptly. Beyond these statutory obligations, Tastenkunst has no contractual duty to provide specific feature enhancements, functional expansions, or ongoing development of the Software.
2.5 Support
Tastenkunst may provide technical support, customer service, or maintenance for the Software. For paid Pro Plans, support is provided as described in the Software, checkout, or order information and as required by mandatory law. Any additional support is provided on a voluntary, best-effort basis and may be changed or discontinued.
2.6 Optional Eternl Pro Plans
Eternl may offer optional paid "Eternl Pro" plans for individuals and businesses ("Pro Plans"). Pro Plans unlock additional software features but do not change the non-custodial nature of the Software. You remain responsible for your wallets, devices, private keys, recovery phrases, transactions, and tax reporting.
The free wallet functionality may remain available separately from Pro Plans. Prices, feature descriptions, billing periods, seat quantities, renewal or cancellation terms, and other commercial terms are shown in the checkout or in the Software before purchase. A Pro Plan gives access to the paid functionality made available for that plan during the relevant access period. It does not guarantee that every current feature, integration, third-party service, blockchain, market data source, or DApp remains available unchanged or indefinitely.
2.7 Individual and Business Plans
An individual Pro license is intended for use by the purchasing user and may not be sold, rented, shared as a service, or used to provide unauthorized access to third parties.
A business Pro license includes three seats unless the checkout or order confirmation states otherwise. The business license administrator may assign, remove, or reassign seats through the seat-management features provided in the Software. Additional seats may be purchased on demand where available. The business customer is responsible for ensuring that only authorized personnel use its seats and that its administrators manage seats appropriately.
2.8 Wallet Signatures, License Transactions, and Local License Files
Eternl does not use traditional user logins for Pro access. To purchase, create, activate, or manage a Pro license, you may be asked to sign data with your wallet keys ("signData") to prove control of a wallet or authorization over a license. Signing data does not disclose your private keys and is distinct from signing a blockchain transaction.
After a successful checkout, you must sign and submit a blockchain transaction containing license metadata on Cardano mainnet or Apex Fusion Prime Mainnet, depending on the license flow shown in the Software. The license becomes usable only after the transaction has been confirmed and indexed by our backend. Blockchain confirmation and indexing can take time and may fail or be delayed for reasons outside Tastenkunst's control.
After the license transaction has been indexed, you may need to sign data again to create a local license file. The local license file grants access to Pro features on the relevant device. If you delete the file, reset the device, reinstall the Software, or move to another device, you may need to activate the license again within the activation limits described below.
2.9 Activation Limits and Anti-Abuse Controls
Each individual license and each business seat license may be active on up to three devices and may be activated up to twenty times. On the twenty-first activation event, all activations for that license or seat may be paused or deactivated automatically as an anti-abuse measure.
These limits apply regardless of whether activation events result from new devices, reinstalls, local data deletion, device resets, failed setup attempts, or other circumstances. The limits are intended to prevent license sharing, resale, and automated abuse, not to penalize ordinary device replacement or legitimate recovery. If your activations are paused or deactivated, contact support to request review. If the review confirms legitimate use and the payment and license remain valid, Tastenkunst will reactivate the license or help restore access as appropriate. Mandatory consumer rights remain unaffected.
Tastenkunst may also suspend, deactivate, or refuse activation of licenses that appear to be shared, resold, abused, fraudulently obtained, subject to chargeback or payment reversal, or otherwise used in violation of these Terms.
2.10 Changes to Pro Features and Paid Services
Pro feature descriptions explain the current product offering; they are not a promise that the feature set will only expand. Tastenkunst may add, remove, replace, suspend, or modify Pro features where there is a valid reason, such as security, abuse prevention, legal or regulatory requirements, changes to blockchain networks, third-party provider changes, interoperability, performance, operational reliability, product improvement, or deprecation of outdated functionality.
Changes will not impose additional charges solely because the change is made. If a change materially and negatively affects a consumer's access to or use of a paid Pro service beyond a minor extent, Tastenkunst will provide clear information about the change and, where required by law, prior notice on a durable medium. Statutory consumer rights, including rights relating to conformity, updates, termination, refunds, or other remedies for digital products, remain unaffected. Urgent security, legal, integrity, or abuse-prevention changes may be applied immediately, with notice provided as soon as reasonably possible.
3. ELIGIBILITY AND EXPORT CONTROL
3.1 Age
You must be at least 18 years old and have the full capacity to enter into this agreement.
3.2 Prohibited Jurisdictions and Export Control
You may not use the Software if you are located in, or a citizen/resident of, any state, country, or region that is subject to sanctions by the United Nations, the European Union, the United States (OFAC), or Germany. Furthermore, you represent and warrant that:
- (i) You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and
- (ii) You are not listed on any U.S. Government list of prohibited or restricted parties.
- (iii) You agree not to export, re-export, or transfer the Software to prohibited countries or individuals in violation of applicable export control laws.
3.3 No Accounts
You do not need to create an account or provide personal data (KYC) to use the Software.
4. RIGHT OF WITHDRAWAL (EU CONSUMERS), PAID DIGITAL SERVICES, AND PRO PLANS
4.1 Free Wallet Software
The Eternl wallet software itself may be provided free of charge. Where no paid digital service is purchased, no statutory right of withdrawal is triggered by the mere download and use of the free wallet functionality. Mandatory consumer rights remain unaffected.
4.2 Paid Pro Plans and Merchant of Record Checkout
If you purchase a Pro Plan, you are purchasing access to paid digital functionality, digital services, or digital content. The specific plan, price, taxes, seat quantity, billing period, payment method, renewal or cancellation details, and other order information are displayed at checkout or in the Software before purchase.
Dodo Payments acts as Merchant of Record for Pro Plan checkout unless the checkout expressly states otherwise. This means Dodo Payments is the seller for the checkout transaction and handles payment processing, local payment methods, taxes, invoices or receipts, fraud checks, refund handling, chargebacks, and payment compliance for that transaction. Tastenkunst provides and operates the Eternl software, license activation, seat-management features, and Pro functionality after successful checkout.
4.3 Immediate Performance and License Activation
Pro access may require immediate technical steps after checkout, including wallet ownership proof by signData, creation and submission of a blockchain license metadata transaction, backend indexing of that transaction, and creation of a local license file. If you are a consumer and want paid Pro access to start during a statutory withdrawal period, the checkout or Software may ask you to expressly request immediate performance and to acknowledge that your statutory withdrawal right may end or be limited once performance begins, as required by applicable law.
This is not a blanket waiver of all consumer rights. If the required request and acknowledgement are not obtained where legally required, Pro activation may be delayed or your statutory withdrawal rights will remain as provided by law.
4.4 Refunds, Chargebacks, and Payment Reversals
Refunds, withdrawal requests, chargebacks, payment disputes, and payment reversals are subject to mandatory consumer law, the checkout provider's rules, and the terms shown at checkout. If Dodo Payments is Merchant of Record, use the instructions in the Dodo checkout, receipt, or customer-support flow for payment refunds or statutory withdrawal requests. You may also contact Tastenkunst at info@tastenkunst.io so we can assist with license identification or technical activation issues.
If a Pro Plan payment is refunded, reversed, disputed, cancelled, found fraudulent, or otherwise not successfully settled, Tastenkunst may suspend or revoke the related license, local license files, business seats, and Pro access, subject to mandatory consumer rights.
4.5 Network Fees and Blockchain Transactions
Blockchain network fees, transaction fees, and any fees paid to validators or network participants for license metadata transactions or other transactions are not paid to Tastenkunst and cannot be refunded by Tastenkunst. Blockchain transactions and public blockchain metadata are generally irreversible.
Do not send us payment card numbers, seed phrases, private keys, or other sensitive credentials when requesting support.
5. USER RESPONSIBILITIES AND SECURITY
5.1 Credentials
You are solely responsible for the confidentiality and security of your private keys, seed phrases (12-24 words), and passwords. Tastenkunst stores no backup of these credentials.
5.2 Loss of Access
If you lose your seed phrase or private key, you will lose access to your funds. Tastenkunst cannot recover them for you.
5.3 Device Security
You are responsible for the security of the device (computer, phone) on which the Software is installed, including keeping the OS updated and free of malware.
6. FEES, PAYMENTS, PRO PLANS, AND TRANSACTIONS
6.1 Network Fees
Transactions on supported blockchains may require the payment of network fees to validators or other network participants. These fees are not paid to Tastenkunst and are beyond our control. This includes ordinary wallet transactions and license metadata transactions required to activate a Pro Plan.
6.2 Pro Plan Fees and Pre-Checkout Information
Tastenkunst may charge fees for Pro Plans, business seats, add-on seats, or other paid functionality. Before you submit a paid order, the Software or checkout will show the material order information, including the selected plan, seat quantity, billing period, renewal or cancellation terms where applicable, total price, taxes or how taxes are calculated, payment method, currency, main functionality, relevant compatibility or interoperability information, license activation steps, Merchant of Record or seller information, and withdrawal or refund information.
If the order is completed through a hosted checkout, that checkout is the final order surface. The final payment button or equivalent order action in checkout must clearly indicate that the order creates a payment obligation.
6.3 Dodo Payments Checkout
Pro Plan checkout is handled through Dodo Payments unless the Software or checkout identifies another provider. Dodo Payments acts as Merchant of Record for the checkout transaction unless the checkout expressly states otherwise. Available payment methods may depend on your country, currency, risk checks, provider availability, and applicable law. Payment options may include local payment methods, cards, wallets, bank-transfer methods, or supported stablecoin/crypto payment options where available.
Dodo Payments collects and processes information required for payment, fraud prevention, tax calculation, invoicing, chargeback handling, and payee or customer identification, such as email address, billing or postal address, VAT or tax information, payment instrument data, and payment status. Tastenkunst does not store your full payment card data, postal address, or payee-identification data in its own license database. Tastenkunst may receive and store limited references needed to reconcile and support the license, such as checkout references, product or plan identifiers, payment status, transaction references, license identifiers, seat quantities, timestamps, and related technical status information.
Your payment transaction may also be subject to Dodo Payments' buyer terms, privacy policy, refund rules, risk checks, and payment method rules.
6.4 License Metadata Transactions
After checkout, the Software may require you to sign and submit a blockchain transaction containing license metadata on Cardano mainnet or Apex Fusion Prime Mainnet. This transaction is public and may be permanently recorded on the relevant blockchain. You must review the transaction before signing. Do not include personal data, payment data, private information, seed phrases, or sensitive business information in blockchain metadata.
Tastenkunst's backend may index the public license metadata transaction and store references required to verify license status, seat status, activation limits, and feature access. Blockchain transactions are generally irreversible, and Tastenkunst cannot delete or alter metadata that has been recorded on a public blockchain.
6.5 Service Fees and Third-Party Fees
Tastenkunst may charge a fee for specific interactions facilitated by the Software interface, such as Swaps (DEX Aggregation), NFT transactions, Pro Plans, business seats, or other DApp or blockchain interactions. These fees are disclosed to you in the relevant checkout, transaction summary, or Software flow before signing or paying.
When using third-party aggregators, on-ramp providers, checkout providers, payment methods, or blockchain networks, those third parties may charge their own fees, which are separate from Tastenkunst fees.
6.6 No Reversal of Blockchain Transactions
You acknowledge that transactions on supported blockchains are generally irreversible. Once a transaction is signed and broadcast, Tastenkunst cannot reverse it or recover funds. Consequently, network fees and service fees paid for attempted or completed blockchain transactions are non-refundable by Tastenkunst, except where required by statutory consumer protection law.
7. THIRD-PARTY SERVICES AND INTEGRATIONS
7.1 DEX Aggregators ("MonsterSwap")
The "MonsterSwap" feature provides an interface to third-party decentralised exchange (DEX) aggregators. MonsterSwap is a UI + backend (relay) feature:
- (a) Quote Requests: When you enter swap parameters (e.g., input amount, assets), the Software sends the request to our backend service. Our backend queries the integrated third-party DEX aggregator APIs for quotes and receives their estimated outcomes.
- (b) Quote Selection: Our backend will select the best available quote based on the amount of output assets returned. If two or more quotes are identical (or effectively identical), our backend may randomly choose among them.
- (c) Transaction Building: If you proceed, the Software sends a transaction-build request to our backend, which forwards it to the selected third-party DEX aggregator. The aggregator constructs an unsigned transaction (or transaction data) and returns it via our backend to your device.
- (d) Self-Custody / No Execution by Tastenkunst: Tastenkunst does not take custody of your crypto-assets and does not execute swaps on your behalf. You remain solely responsible for reviewing the transaction details and you must sign the transaction with your own keys. Only you can authorise and submit the transaction to the blockchain.
- (e) Third-Party Terms and Risk: The DEX aggregators and DEX protocols are independent third parties. Your use of MonsterSwap may be subject to their terms and privacy notices. Tastenkunst is not responsible for their availability, security, pricing, slippage, execution, MEV/ordering effects, smart contract behaviour, or any resulting loss. Interacting with smart contracts involves high risk.
- (f) Fees: MonsterSwap may display and charge a service fee (e.g., an Eternl or aggregator service fee) in addition to network and protocol fees. All fees and estimated outcomes will be shown to you before you sign the transaction. Transaction results are final once confirmed on-chain, except where mandatory consumer law provides otherwise.
Swap Quotes; Slippage; No Best-Rate Guarantee: Any swap quote, output estimate, route, or fee information displayed in the Software is an estimate only and may change before execution due to market volatility, liquidity, slippage, network conditions, mempool congestion, or third-party service behavior.
Swap transactions may fail, be delayed, or execute at a different effective price than estimated. You are solely responsible for reviewing and verifying all transaction details (including recipient address, amounts, fees, slippage tolerance, and route) before signing and submitting a transaction.
Multi-Provider Selection (Informational Only): Where the Software displays quotes from multiple third-party providers/aggregators, any selection, ordering, highlighting, or recommendation is provided for informational purposes only and does not constitute an endorsement, guarantee of execution quality, or a representation that the best available rate is shown.
We do not warrant that all available providers are included. Provider selection may be based on factors such as liquidity, fees, expected output, response time, reliability, availability, or other criteria and may change over time.
7.2 On-Ramp/Off-Ramp
The "Buy ADA" feature links to third-party providers. When you click these links, you leave our Software. We are not responsible for KYC, payment processing, or the delivery of funds by these providers.
7.3 DApps
The DApp Browser allows you to connect to third-party decentralized applications. We do not vet, audit, or endorse these DApps. Interacting with smart contracts involves high risk.
7.4 Affiliate Links and Hardware Wallets
The Software may contain links to third-party websites where you can purchase hardware wallets or other products ("Affiliate Products"). These links may be affiliate links, meaning Tastenkunst may earn a commission if you make a purchase.
- (a) No Seller Relationship: Tastenkunst acts solely as an advertiser. Any contract for the purchase of a hardware wallet is formed strictly between you and the third-party vendor.
- (b) Disclaimer: We do not manufacture, inspect, or ship these devices. We make no warranties regarding the quality, security, or delivery of Affiliate Products.
7.5 Payment Checkout Providers
Dodo Payments and other checkout or payment providers are independent third parties. For Pro Plan checkout, Dodo Payments acts as Merchant of Record unless the checkout expressly states otherwise. Dodo Payments is responsible for the payment transaction, supported payment methods, tax handling, invoices or receipts, fraud checks, refund processes, chargebacks, and payment compliance for that transaction. Tastenkunst remains responsible for the Eternl software, license activation, seat-management features, and Pro functionality it provides.
Checkout-provider services may be subject to their own terms, privacy policies, supported-country rules, payment method rules, sanctions screening, fraud checks, and compliance requirements. Tastenkunst is not responsible for payment methods being unavailable, declined, delayed, reversed, overpaid, underpaid, or subject to additional provider review, except where mandatory law provides otherwise.
8. STAKING
8.1 Non-Custodial Staking
The Software allows you to delegate your ADA to stake pools on the Cardano network. This process is non-custodial; your funds remain in your wallet and are never locked by or transferred to Tastenkunst.
8.2 Third-Party Stake Pools
The vast majority of stake pools visible in the Software are operated by third parties. Tastenkunst has no control over these pools, their uptime, fees, or performance.
8.3 Company-Operated Pools
Tastenkunst may operate its own stake pools (e.g., under the ticker "TITAN").
- (a) No Special Treatment: These pools are listed alongside third-party pools without preferential algorithmic ranking.
- (b) No Guarantee: While we strive for high availability, we do not guarantee 100% uptime.
- (c) No Liability for Missed Rewards: Tastenkunst is not liable for any missed staking rewards ("potential profits") resulting from network parameters, saturation, downtime, software updates, or maintenance of our pools.
8.4 Rewards
Staking rewards are determined by the Cardano blockchain protocol. Any Annual Percentage Yield (APY) displayed is an estimation only.
9. USER CONTENT, MESSAGING, REPORTING, AND ENFORCEMENT
9.1 Availability; On-Chain Nature
Certain features of the Software may allow you to create, publish, transmit, or display information such as messages, labels, notes, usernames, or other content ("User Content"), including via blockchain transactions and public metadata. If User Content is published to a public blockchain, it may be publicly visible, globally accessible, and effectively immutable. You are solely responsible for deciding what you publish and for any consequences arising from making information public.
9.2 Your Responsibilities for User Content
You represent and warrant that:
- (i) you have all rights necessary to submit your User Content;
- (ii) your User Content is accurate to the best of your knowledge;
- (iii) your User Content and your use of the Software comply with applicable law and these Terms; and
- (iv) your User Content does not infringe or violate the rights of any third party (including intellectual property, privacy, and publicity rights).
9.3 Prohibited Content and Misuse
You must not use the Software (including any messaging or content features) to create, transmit, store, or display User Content that:
- (a) is unlawful, fraudulent, deceptive, infringing, threatening, harassing, hateful, abusive, sexually exploitative, defamatory, or privacy-invasive (including doxxing);
- (b) promotes violence or illegal activity;
- (c) violates export controls or sanctions;
- (d) contains malware, phishing, or other harmful code;
- (e) is spam or otherwise interferes with the Software or third-party services (including by overloading infrastructure, scraping, or denial-of-service behavior);
- (f) impersonates another person or entity, or misrepresents affiliations; or
- (g) otherwise creates a material risk of harm to users, third parties, or the integrity of the Software.
9.4 Limited License to Operate the Feature
To the extent the Software (or our infrastructure) technically processes, relays, caches, or displays your User Content (for example, to render blockchain metadata, relay a message request, or deliver notifications you requested), you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, transmit, cache, display, and perform your User Content solely as necessary to operate, maintain, and provide the relevant feature and to enforce these Terms. This license ends when the User Content is removed from our systems, except to the extent we must retain records for legal compliance or to the extent the User Content persists on a public blockchain outside our control.
9.5 No General Monitoring Obligation
We do not generally monitor or pre-screen User Content, and we do not assume a general duty to do so. However, we may implement reasonable measures to prevent abuse, spam, or security risks, and we may review User Content where required by law, in response to notices, or to protect users and the integrity of the Software.
9.6 Reporting; Notice-and-Action; Copyright and Rights Complaints
If you believe User Content is unlawful, abusive, or infringes your rights, you may notify us at info@tastenkunst.io.
Please include: (i) a clear description of the content and why you believe it is unlawful/infringing; (ii) where it appears (for example, transaction hash, address, platform, timestamp, or other identifiers; screenshots help); (iii) your name and contact details; and (iv) any supporting information or authority to act (where relevant).
We will review notices in a reasonable timeframe and may take actions such as: removing or limiting display of content within our interfaces; disabling access to a feature; restricting abuse vectors; or taking other measures we deem necessary to comply with law or protect users and the Software. Because blockchain data may be immutable, we may be unable to delete or modify content published on-chain; our actions may therefore be limited to what we can control (for example, how content is displayed within our interfaces).
9.7 Enforcement; Repeat Misuse; Termination
We may restrict, suspend, or terminate your access to the Software (in whole or in part) if you violate this Section, repeatedly receive valid notices, use the Software for prohibited purposes, or create material legal, security, or operational risk. This is without prejudice to any other remedies and subject to mandatory consumer law.
10. FORKS AND CHAIN SPLITS
In the event of a fork in the Cardano blockchain or any other supported network, Tastenkunst reserves the right to determine, in its sole discretion, which chain to support within the Software. We are under no obligation to support both branches of a fork, and you acknowledge that unsupported forked assets may be inaccessible via the Software.
11. APP STORE TERMS
11.1 General
If you access the Software via an application store (e.g., Apple App Store, Google Play), you acknowledge that these Terms are between you and Tastenkunst only, not with the App Store provider. The App Store provider is not responsible for the Software or its content. You agree to comply with all applicable third-party terms of agreement (e.g., your wireless data service agreement) when using the Software.
11.2 Apple Third-Party Beneficiary
If you access the Software via the Apple App Store, you acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
12. INTELLECTUAL PROPERTY
12.1 License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software for your personal or internal business use.
12.2 Ownership
The Software and its underlying code (unless open source) remain the property of Tastenkunst GmbH.
12.3 Feedback
If you provide us with any feedback, suggestions, or comments regarding the Software ("Feedback"), you hereby assign to Tastenkunst all rights, title, and interest in and to such Feedback. We are free to use such Feedback for any purpose without acknowledging or compensating you.
13. DATA PROTECTION, PAYMENT DATA, AND LICENSE RECORDS
13.1 Privacy Policy
Your use of the Software is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and share technical data, license data, payment references, support data, and other relevant information.
13.2 No User Accounts; Wallet-Based Proof
Eternl does not use traditional user accounts or passwords for wallet access or Pro license activation. License flows may use wallet signatures to prove control of a wallet or authorization over a license. These signatures do not disclose your private keys or seed phrases. You must never disclose your private keys, seed phrases, spending passwords, or hardware-wallet PINs to Tastenkunst, Dodo Payments, support staff, or any third party.
13.3 Pro License Records and Blockchain Metadata
Pro license metadata may be published to Cardano mainnet or Apex Fusion Prime Mainnet. Blockchain metadata is public, immutable, and globally accessible. The license metadata is designed to avoid directly identifying natural persons, but public wallet identifiers, transaction hashes, timestamps, product references, seat references, and related data may still be linkable to other information by you or third parties.
Tastenkunst may process and store limited license-related references needed to provide and protect Pro access, including license identifiers, transaction hashes, public wallet or account references, plan or product identifiers, business seat counts, seat assignment status, activation counts, activation timestamps, device or installation references, revocation status, and support or fraud-prevention flags. We use this information to verify licenses, enforce activation limits, manage business seats, prevent abuse, troubleshoot activation issues, and provide support.
13.4 Payment and Billing Data Handled by Dodo Payments
Dodo Payments acts as Merchant of Record for Pro checkout unless the checkout expressly states otherwise. Dodo Payments may collect and store customer, billing, tax, payment, and payee-identification information required for payment processing and compliance. Tastenkunst does not store your full payment card data, postal address, or payee-identification data in its own license database. To the extent Tastenkunst receives payment references or status data from Dodo Payments, we use them only to reconcile purchases, activate or revoke licenses, handle support, prevent fraud, and comply with legal obligations.
13.5 Business Seat Administration
Business license administrators are responsible for assigning and removing seats only for authorized users. Seat-management information should not include sensitive personal data. If a business administrator uses wallet identifiers, labels, or other information to manage seats, the business customer is responsible for ensuring that such use is lawful and appropriate for its organization.
13.6 Automated Anti-Abuse Controls and Support Review
License activation limits may be enforced automatically. If an automatic activation limit or anti-abuse control deactivates or blocks a license, you may contact support to request human review. Tastenkunst may ask for information reasonably necessary to identify the license or payment reference, but you must not send seed phrases, private keys, payment card numbers, or other sensitive credentials.
13.7 Data Rights (EU Data Act)
In accordance with the EU Data Act, you may have rights regarding access to and portability of certain data generated by your use of the Software. As a non-custodial wallet, most usage data (private keys, address labels, history) is generated and stored locally on your device or publicly on the blockchain, not on Tastenkunst's servers. You retain control over this data, subject to the limits of public blockchain immutability and any local backups or exports you create.
14. TERM, TERMINATION, AND LICENSE SUSPENSION
14.1 Termination by User
You may terminate this agreement at any time by deleting the Software and ceasing all use. Deleting the Software does not automatically reverse blockchain transactions, refund network fees, delete public blockchain metadata, cancel payment-provider records, or remove data held by Dodo Payments or other third-party checkout providers.
14.2 Suspension or Termination by Tastenkunst (for cause)
We may suspend access to, deactivate a license or seat, revoke local license files, or terminate the Software or Pro access (in whole or in part) immediately if we reasonably determine that:
- (a) you have materially breached these Terms;
- (b) your use is unlawful, fraudulent, abusive, or creates a security risk;
- (c) we must do so to comply with law, a court order, a sanctions requirement, a payment-provider requirement, or a binding request from an authority;
- (d) continued provision would expose Tastenkunst, users, payment providers, blockchain networks, or third parties to a material risk of harm;
- (e) a Pro Plan payment is refunded, reversed, disputed, cancelled, charged back, found fraudulent, or otherwise not successfully settled;
- (f) a license transaction is invalid, missing required metadata, associated with abuse, or cannot be verified by the backend;
- (g) a license or business seat is shared, resold, rented, assigned outside the permitted scope, or used to bypass activation or seat limits; or
- (h) the activation limits described in Section 2.9 are exceeded.
Where reasonably possible, we will inform you of the suspension, deactivation, or termination and the main reason. Some anti-abuse, security, payment, or legal actions may be automatic or immediate. You may contact support to request review of activation-limit or anti-abuse actions. Mandatory consumer rights remain unaffected.
14.3 Discontinuation and Material Changes
Tastenkunst may stop offering new Pro purchases, stop offering renewals, discontinue free features, or discontinue optional features for valid operational, legal, security, technical, or product reasons. For active paid Pro access, material feature changes, discontinuation, termination, refunds, and remedies are governed by Sections 2.10 and 4 and by mandatory consumer law. We will not remove paid Pro access for convenience without providing any refund, alternative access, notice, or other remedy required by applicable law.
14.4 Effect of Termination or License Deactivation
Termination ends your right to use the Software or the affected paid features. License suspension or deactivation may disable Pro features, local license files, business seats, or seat-management access. Because the Software is non-custodial, termination or license deactivation does not affect your ownership of on-chain assets. You remain responsible for securely backing up your recovery phrase/keys and for accessing your assets with compatible software.
If activation limits are exceeded and all activations are deactivated, you must contact support for review. If the review confirms legitimate use and the payment and license remain valid, Tastenkunst will reactivate the license or help restore access as appropriate. Reactivation may be refused where the license is invalid, unpaid, refunded, reversed, abused, shared, resold, or otherwise used in violation of these Terms.
15. DISCLAIMER OF WARRANTIES
Nothing in these Terms limits or excludes mandatory statutory rights of consumers under applicable law. In particular, mandatory rights under German consumer law, including rules for digital products (e.g., §§ 327 ff. BGB), remain unaffected.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND.
WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED, OR THAT ANY INFORMATION PROVIDED THROUGH THE SOFTWARE IS ACCURATE OR RELIABLE.
16. LIMITATION OF LIABILITY
Nothing in this Section 16 limits or excludes liability where such limitation or exclusion is prohibited by applicable law, and mandatory consumer rights remain unaffected.
16.1 Unlimited Liability
Tastenkunst is liable without limitation for damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for injury to life, limb, or health, or under the German Product Liability Act (Produkthaftungsgesetz).
16.2 Cardinal Duties
In cases of slight negligence (einfache Fahrlässigkeit), Tastenkunst is only liable for the breach of material contractual obligations (Cardinal Duties). Cardinal Duties are obligations the fulfillment of which is essential to the proper performance of the contract and on which the User may rely. In such cases, liability is limited to typical, foreseeable damages.
16.3 Data Loss
Liability for data loss is limited to the typical recovery effort required had regular backups been made by the User.
16.4 Blockchain Risks
Tastenkunst is not liable for losses resulting from:
- User error (e.g., forgotten passwords, sending funds to wrong addresses).
- Blockchain network failures, forks, or congestion.
- Smart contract bugs in third-party DApps or protocols.
- Payment-provider delays, declined payments, chargebacks, fraud reviews, or checkout-provider outages.
- Blockchain confirmation, indexing, metadata, activation, or license-file issues outside Tastenkunst's reasonable control.
- Hacks or phishing attacks targeting the User.
17. FORCE MAJEURE
Tastenkunst shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
18. INDEMNIFICATION (BUSINESS USERS ONLY)
This Section 18 applies only if you are using the Software as a Business User (Unternehmer). If you are a consumer (Verbraucher), this Section 18 does not apply.
To the extent permitted by applicable law, you agree to indemnify and hold harmless Tastenkunst, its officers, directors, employees, and agents from and against third-party claims, damages, losses, liabilities, and reasonable costs (including reasonable legal fees) arising out of or relating to:
- (a) your intentional or negligent breach of these Terms;
- (b) your unlawful use of the Software; or
- (c) content or data you provide that infringes third-party rights.
This indemnity obligation applies only to the extent that the claim was caused by you and does not apply to the extent that Tastenkunst is responsible for the claim.
19. GOVERNING LAW AND JURISDICTION
19.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
19.2 Jurisdiction
If the User is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes is Leipzig, Germany. If you are a consumer within the EU, mandatory statutory consumer protection regulations of your country of residence remain unaffected.
19.3 Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
20. SEVERABILITY AND LANGUAGE
20.1 Severability
Should any provision of these Terms be or become invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions. The invalid provision shall be deemed replaced by a valid provision that comes closest to the economic intent of the parties.
20.2 Language
These Terms may be translated into other languages for your convenience. In the event of a dispute or inconsistency between the English version and any translated version, the English version of these Terms shall prevail to the extent permitted by law.
21. CHANGES TO TERMS
21.1 Valid Reasons
We may change these Terms only for valid reasons, such as:
- (a) to comply with changes in law or regulatory requirements;
- (b) to address security issues, prevent abuse, or respond to material risk;
- (c) to reflect changes to the Software, paid services, checkout providers, licensing, seat management, activation processes, or supported networks where the change is reasonable for users; or
- (d) to correct errors, improve clarity, or reflect operational changes without reducing mandatory user rights.
21.2 Notice and Review (Consumers)
If you are a consumer (Verbraucher), we will notify you of material changes in clear and understandable language before they take effect, by making the updated Terms available in the Software or on our website and providing the effective date and the main changes. Where required by law, you will be able to review and accept the updated Terms before continued use of the affected service.
21.3 Notice (Business Users)
If you are using the Software as a Business User (Unternehmer), we will notify you of material changes at least 14 days before they take effect, unless a shorter period is required for legal, security, abuse-prevention, payment-provider, or integrity reasons.
21.4 Immediate Changes
Where a change is required by law, a binding authority request, a payment-provider requirement, or is necessary to address a security vulnerability, abuse vector, or integrity risk, we may apply the change immediately. In that case, we will notify you as soon as reasonably possible.
21.5 Continued Use
Continued use of the Software after the effective date of updated Terms constitutes acceptance of the updated Terms only if you had the opportunity to review the changes and, where required by law, the ability to accept the changes or stop using the affected service before they took effect. Mandatory consumer rights remain unaffected.
22. MISCELLANEOUS
22.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Tastenkunst regarding the Software.
22.2 No Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Tastenkunst's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
RISK DISCLAIMER
NO FINANCIAL ADVICE: The information provided by Eternl and Tastenkunst does not constitute investment advice, financial advice, trading advice, or any other sort of advice.
VALUE VOLATILITY: Crypto assets, including ADA and Cardano native tokens, are highly volatile. You may lose all value in your assets.
TECHNOLOGY RISK: The Software interacts with the Cardano blockchain. Tastenkunst does not control the blockchain. Bugs in the Cardano protocol, 51% attacks, or quantum computing threats could result in loss of funds.
SMART CONTRACT RISK: When you use the "MonsterSwap" feature or interact with DApps via the Browser, you are interacting with smart contracts. These may contain bugs, exploits, or security vulnerabilities that could lead to a total loss of funds. Tastenkunst is not responsible for third-party smart contracts.
PRO LICENSE AND INDEXING RISK: Pro activation may depend on checkout completion, blockchain confirmation, public license metadata, backend indexing, wallet signatures, and local license files. Delays, mistakes, invalid metadata, local data loss, device resets, or exceeded activation limits may prevent or interrupt Pro access until the issue is resolved or support review is completed.
REGULATORY RISK: The regulatory status of crypto assets and wallet providers is evolving (e.g., MiCA in EU, SEC in US). New regulations could negatively impact the functionality of the Software or your ability to access your assets.
TAXATION: You are solely responsible for determining what, if any, taxes apply to your crypto transactions. Tastenkunst does not calculate, collect, or report taxes on your behalf.
